Frequently asked questions

Is gratuity calculated on basic salary or total salary in the UAE?

Gratuity is calculated on your last basic salary only. Housing allowance, transport allowance, bonuses and commissions are excluded. This is set out in the UAE Labour Law, so check your contract to see how your pay is split between basic and allowances.

Do I get gratuity if I resign in the UAE?

Yes. Under Federal Decree-Law No. 33 of 2021 (in force since February 2022) the old rule that reduced gratuity for resigning employees was abolished. Whether you resign or are terminated, you receive the same full gratuity — provided you completed at least one year of continuous service.

What happens if I worked less than one year?

No gratuity is due for service under one continuous year. Once you pass one year, you are also paid pro-rata for any part-years — for example 3 years and 6 months of service earns 3.5 years' worth of gratuity.

Is there a maximum limit on UAE gratuity?

Yes. Total gratuity cannot exceed two years' basic salary (24 months), no matter how long you worked. This calculator applies the cap automatically.

Does unpaid leave affect my gratuity?

Days of unpaid absence are excluded from the service period when calculating gratuity. If you took significant unpaid leave, subtract it from your service length before using the calculator.
